On January 16, 2014 a meeting was held between Timothy Charles Holmseth and Traci Kapella, program manager, Minnesota Guardian Ad Litem program for the 9th Judicial District.

Allegations of criminal extortion against the Guardian Ad Litem program were discussed.

Holmseth reiterated to Kapella his legal position that Matthew Petrovich, guardian ad litem, violated federal laws when he systematically harassed and pressured Holmseth to stop filing complaints and document requests, or publishing information that was critical of law enforcement and attorneys in the 9th Minnesota Judicial District – or risk losing his existing parental rights to his son.

Holmseth asserts that rogue members of the City of East Grand Forks (EGF) Police Department (EGFPD), EGF City Attorney Ronald Galstad, Polk County Sheriff’s Office (PCSO), Minnesota Public Defender’s Office, and attorneys with the Charlson & Jorgenson law firm have systematically used Holmseth’s small son to extort him.

Holmseth chronicled the activities of Petrovich - ACTIVITIES OF MATTHEW J. PETROVICH, GUARDIAN AD LITEM, 9TH MINNESOTA JUDICIAL DISTRICT

Holmseth further articulated the extent of Petrovich’s tactics in a statement of legal position and complaint against Petrovich submitted to Kapella in December, 2013.

“Petrovich is exploiting his access to Timothy Holmseth’s eight year-old son, and threatening to make unfavorable recommendations to the Family Court, which will have an adverse affect on Timothy Holmseth’s parental rights,” Holmseth stated.

“Petrovich has been pressuring Timothy Holmseth to stop his legal actions and whistle-blowing-type publishing activities but Holmseth refused/refuses to capitulate to Petrovich’s threats. Petrovich has taken issue with the fact Timothy Holmseth has filed many complaints and grievances against officials,” the statement continues.

The statement then addressed that fact that during a court hearing on October 9, 2013, Petrovich made good on the threats.

“Petrovich also told the Judge that Timothy Holmseth’s online publishing affects his son. The publishing to which Petrovich is referring can be found primarily at www.writeintoaction.com where Timothy Holmseth, an experienced reporter and journalist, is chronicling corruption in the Ninth Minnesota Judicial District,” Holmseth said.

Holmseth maintains that his son is in no way ever exposed or introduced to his professional work or publishing, and the bogus assertion is a desperate attempt by officials to side-step the U.S. Constitution and violates Holmseth’s freedom of press and speech rights.

During the October 9, 2013 court hearing, Petrovich lamented that Holmseth filed a complaint against EGF City Attorney Ronald Galstad. This was not the first time Galstad had been referenced during a hearing regarding Holmseth’s son. On December 18, 2012 Holmseth expressed his concerns about Galstad in a letter to Honorable Donna Dixon, Roseau County Courts, after the meddling City Attorney’s name came up in a Family Court hearing.

“Attorney Mattocks (Charlson & Jorgenson – Thief River Falls) stated in open court he had recently spoken to East Grand Forks City Attorney Ronald Galstad regarding me. Mattocks advised the Court, that Galstad advised him, that a Stay of Adjudication in a separate case between The City of East Grand Forks and me had been “revoked”. Mattocks asked the Court to consider that in decisions to be made pertaining to my small son” Holmseth said.

Holmseth’ statement to the Judge continued.
 
“There presently exists a complaint filed by me to the City of East Grand Forks, and, the Federal Bureau of Investigation, against Attorney Ronald Galstad. Lt. Detective Rodney Hajicek, Sgt. Detective Chris Olson, and [REDACTED]. The Complaint details the involvement of said individuals in an illegal scheme wherein the City would assist [REDACTED] in acquiring a [XXXXX] order against me from a [XXXXX] County divorce judge, which would set forth severe (un-constitutional) restrictions on my publishing rights. Florida was chosen as the State to obtain the Order because Minnesota would not do such a thing. The City employees assisted [REDACTED] by preventing my defense. The City deliberately refused to honor three separate FOI requests for documents that would have created a successful defense for me in that case. Death threats passed along to me by [REDACTED] private investigator, warning me to not appear in Florida for the hearing, were not investigated by Lt. Hajicek and he purposely generated no report. After the fraudulently obtained Florida order was issued without me being present; the City arrested and incarcerated me. Evidence that surfaced December 14, 2012 proves the City hid documents that implicated the City and [REDACTED]” Holmseth’s letter said.  

The record shows Galstad has been obsessed with Holmseth since at least October 29, 2012 when, according to a complaint filed to the Minnesota Lawyer Board, Michael LaCoursiere, Minnesota Public Defender’s Office, passed a message along to Holmseth that Galstad was going to call two police officers to lie on the witness stand if Holmseth insisted on a jury trial and didn’t accept an Alford plea.

But Galstad’s original interest in Holmseth dates all the way back to 2009, when Holmseth began conducting interviews with key figures in the kidnapping of HaLeigh Ann-Marie Cummings.

While Holmseth’s work product and investigative efforts as a journalist were of interest and use to the FBI, Galstad and the EGFPD had taken an active interest in assisting the very same individuals the FBI was investigating. Records obtained from the County Attorney’s Office show Lt. Hajicek asked Polk County Attorney Greg Widseth if there was anything they could charge Holmseth with after Hajicek learned the FBI was conducting interviews in Florida based upon Holmseth’s information.

The stunning gesture by Hajicek to the County Attorney indicates both officials viewed Holmseth as a threat to something.

Neither Widseth nor Hajicek picked up the phone and contacted the FBI to inform them that the EGFPD was receiving phone calls and communications from a group out of Florida involved with a kidnapping case.

Both Widseth and Hajicek's actions indicated they might be hiding something, locally.

There is strong evidence that the Minnesota Family Court is being used to intimidate, extort, and harass Holmseth.

On August 16, 2013 Holmseth confronted Matthew Petrovich and Attorney Michael Mattocks after receiving yet another Affidavit authored by Rhonda Callahan that was splattered with references to the HaLeigh Cummings kidnapping.

Callahan’s filing to the Court appeared to be more of a request for a ruling from the Court regarding Holmseth’s credibility as an author; as opposed to an action that actually pertained to their child.

You asked me a question today regarding my objection to the Minnesota District Court being used as an avenue to slander and defame me and my business by proxy via court filing submitted by Rhonda Callahan through the law firm Charlson & Jorgenson.

I was TOLD HaLeigh Cummings is “alive” and being “moved around”. I was told that by a member of the group that staged her kidnapping. In 2010 the Jacksonville FBI requested the Minneapolis FBI interview me and obtain audio recordings of interviews I conducted with people involved in that case. I had to take two days off from work just to prepare the discs for the Special Agent.

You, Rhonda Callahan, and Charlson & Jorgenson, have taken a unique and specific interest in my profession as a journalist and author. You seem obsessed with guiding the perceptions of HaLeigh’s disappearance, as you attempt to influence anyone who reads the public records generated by this case.

In Rhonda Callahan’s last Affidavit she used the following phrases to describe me, my integrity, my mental health, and the validity of my journalistic work product.  

 “…fabricated conspiracy…”

“…invented conspiracy…”

“…conspiracy theories…”

“…delusional conspiracy theories…”

“…his HaLeigh Cummings conspiracy…”

“…Petitioner’s imagined conspiracy…”

If you have information about the disappearance of HaLeigh Ann-Marie Cummings that qualifies you to say, or support statements alleging I “imagine” or “invent” things that I publish about the HaLeigh Cummings case, then you should promptly turn that information over to the FBI, Putnam County Sheriff’s Office (Florida), or Crimestoppers.   

If you don’t have information to back those assertions up – then you have no legal basis or right to make those statements about me or my business in a Minnesota Family Court.

Holmseth advised Kapella that Petrovich and Galstad fully expected to get away with their activities, but were later doomed for exposure when an official statement from the Minnesota Bureau of Criminal Apprehension (BCA) revealed Galstad had been lying to Honorable Tamara Yon about a relationship he claimed to have with that State agency regarding Holmseth. 

In a complaint filed against Galstad in January of 2014, Holmseth supplied evidence that his computer’s hard-drive, which Galstad and the EGFPD seized and secretly searched without a warrant, with the help of the Polk County Sheriff’s Office, had been illegally activated in police custody and all agencies and entities involved lied to the Court about the matter.
