North Dakota CPS team repeatedly protected vulnerable child from predatory Minnesota Guardian ad Litem program

Guardian ad Litem abandons client and disappears as facts surrounding institutional kidnapping case continue to emerge

Grand Forks County Child Protective Services has repeatedly disrupted attempts by the Minnesota Guardian ad Litem program to execute a state-sponsored kidnapping of a journalist’s child.

GFCCPS recently submitted a report that is presently in front of Minnesota District Judge Tamara Yon regarding HOLMSETH VS. CALLAHAN.

The situation began in 2009 after Timothy Charles Holmseth, journalist/author, East Grand Forks, interviewed law enforcement’s suspects in the kidnapping of HaLeigh Ann-Marie Cummings.

Holmseth was told the truth about the high-profile fake kidnapping, and subsequently cooperated with the Minnesota FBI by providing some of his audio interviews with the suspects.

Sine that time, Grand Forks County CPS team has repeatedly sifted through unprecedented allegations and lies brought against Holmseth, as attempts are continuously made to close his investigative publication down under ‘color of law’ using the Minnesota Family Court.

In 2009, Rhonda Callahan, Grand Forks, made five CPS complaints against Holmseth regarding their child in common. The complaints, made in Polk County, Minnesota, were all made within a period of four months – each was unfounded.

In 2011, Grand Forks CPS investigated new claims made against Holmseth by Callahan. The findings were “No Services Required or Recommended – No Risk Factor for Abuse Identified”. The lengthy investigation includes a checklist that reveals not one single accusation made by Callahan was found to be even close to true. The ruthless scorched-earth defamation campaign against Holmseth even included false allegations against his teenage daughter.

Shortly after Holmseth was cleared, Matthew Petrovich, guardian ad litem, 9th Minnesota Judicial District, was assigned to the case.  

Although any signs of abuse and/or neglect actually pointed to Callahan as the perpetrator, court files reveal a near maniacal campaign by Petrovich to convince a Minnesota District Judge that Holmseth’s publication harms his child, and his parental rights should be leveraged against his First Amendment protections.

In 2013, Petrovich, Callahan, and Attorney Michael Mattocks, convinced a District Judge that Holmseth should be subjected to a third psychological/parental capacity evaluation and required to see his son under supervision.

Affidavits and letters submitted to the Court by Callahan and Petrovich described Holmseth as ‘paranoid’ and ‘delusional’ and ‘psychotic’. The two testified to the Court they believed Holmseth’s “online activities” were harming the child.

Holmseth’s online publication contains investigative product concerning corrupt government agencies – often regarding high profile cases. Holmseth has published a considerable amount of information that is embarrassing to the City of East Grand Forks, Polk County Sheriff’s Office, and select members of the legal community in the 9th Minnesota Judicial District.

In December, 2013, Dr. Madaline Barnes PhD, Sanford Medical Center, submitted her findings to the Court after examining Holmseth. Dr. Barnes’ findings declared un-equivocally, that Holmseth suffers absolutely no mental or psychological problems, is a good and loving father, and his parenting-time should be re-instated without delay.

In March, 2014, Callahan was investigated by Grand Forks CPS after disclosures were made by a minor child regarding the living environment provided by Callahan. The CPS assessment stated a social worker discussed the fact Callahan left her young child home alone with un-supervised access to the internet. Callahan admitted to what took place and agreed to put parental controls on her computer and gadgets.

The Court is presently reviewing email evidence that shows Callahan was actively assisting suspects in the HaLeigh Cummings kidnapping by sending them embarrassing content about Holmseth to be anonymously published on the Web.

Shortly after the recent CPS report regarding Callahan, an incident with Holmseth’s child required an investigation by Petrovich. Petrovich stated in writing he was in the process of gathering information.

However – while Petrovich was supposed to be investigating, Holmseth notified Parties he was filing a new court motion regarding the on-going situation. Five minutes after Holmseth made the notification, Petrovich announced he was taking a two week vacation and would be unavailable.  

Petrovich ceased his investigation and disappeared – nobody knows where he is.

Traci Kapella, supervisor, Minnesota GAL program, has not replied to Holmseth regarding the situation.

Suzanne Alliegro, administrator, Minnesota GAL program, has no comment.
